Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Brew Shots ("we," "us," or "our"), the operator of brewshots.ai.

By creating an account or using our platform — including clicking "Sign in with Google" — you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use Brew Shots.

These Terms apply alongside our Privacy Policy, which explains how we handle your data.

Brew Shots is an AI-powered platform that generates professional product photos and videos from images of clothing and apparel that you upload. You upload a product image, our AI analyzes it, selects a virtual model, and produces a set of photoshoot-quality images and optional video content.

Generations are powered by third-party AI infrastructure. While we work to deliver consistent, high-quality results, AI-generated output is inherently variable. We do not guarantee that every generation will meet your expectations, and we are not responsible for the creative output of AI models.

You are responsible for all activity that occurs under your account. If you believe your account has been accessed without your authorization, contact us immediately at hello@brewshots.ai.

We reserve the right to refuse registration or cancel accounts at our discretion.

Brew Shots is designed specifically for clothing and apparel product photography. You may use the platform only to generate photoshoot content for clothing items such as shirts, dresses, pants, jackets, activewear, and similar garments.

You must not use Brew Shots to:

You retain full ownership of the product images you upload to Brew Shots. By uploading images, you grant us a limited license to store, process, and transmit those images solely for the purpose of generating your photoshoot content.

You represent and warrant that:

We do not use your uploaded product images to train AI models. Your images are sent to third-party AI infrastructure solely to perform your generation request and for no other purpose.

We are not responsible for content you upload. If we receive a valid intellectual property complaint regarding your uploaded content, we may remove it and suspend your account.

Brew Shots uses a token system called Brew Bucks. You purchase Brew Bucks in advance and spend them to generate content — 1 Brew Buck per photo, 10 Brew Bucks per video.

Brew Bucks are:

All payments are processed securely by Stripe. By making a purchase, you agree to Stripe's Terms of Service. We do not store your payment card details.

All prices are listed in US dollars and are subject to change. We will provide at least 14 days' notice by email before any price increase takes effect. Price changes do not apply to Brew Bucks you have already purchased.

Generation charges. When you start a generation, the Brew Bucks required for that run are deducted from your balance before the generation runs. If the generation does not complete successfully, the full amount is automatically credited back to your account. If you believe a charge or refund is incorrect, contact us at hello@brewshots.ai and we will review your account in good faith.

Brew Bucks may be deducted when you start a generation. See Section 7 for how failed generations affect your balance, and how to contact us if you believe a charge was incorrect.

We reserve the right to modify, limit, or discontinue any feature of the platform at any time. We will provide reasonable notice of significant changes.

Brew Shots is provided "as is" and "as available" without warranties of any kind, either express or implied. We specifically disclaim any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

To the maximum extent permitted by applicable law, Brew Shots and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform — including lost profits, lost sales, or business interruption — even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or your use of Brew Shots shall not exceed the total amount you paid us in Brew Bucks purchases in the 90 days preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. For significant changes — such as changes to pricing, ownership rights, or the refund policy — we will notify you by email at least 14 days before the change takes effect.

Your continued use of Brew Shots after updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the platform and may request a refund under the terms of Section 8.

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law principles.

Informal resolution first. Before filing any formal proceeding, you agree to contact us at hello@brewshots.ai and attempt to resolve the dispute informally for at least 30 days. Most concerns can be resolved quickly this way.

Small claims court. Either party may bring a qualifying claim in small claims court in the county where you reside (or, for Brew Shots, in San Francisco County, California) without first engaging in the informal resolution process above.

Arbitration. If a dispute cannot be resolved informally and does not qualify for small claims court, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, conducted in English. You and Brew Shots each waive any right to participate in a class action lawsuit or class-wide arbitration.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights or prevent ongoing harm.
